Traveling in Time: The New California Time-Share Act

Space and time, the scientists tell us, are related. Space travel, while still limited, has come a long way from science fiction books, though still constituting a frontier to be conquered. But, down to earth, we have already conquered another space-time travel frontier. In fact, people have been traveling “in time” for more than a generation to spaces in various geo-graphic locations, through ownership of earthbound time-share interests.

While the concept of earthbound travel through acquisition of timeshare interests is not new, the vehicles used have evolved dramatically. We now have a menu of various time-share products which, since July 1, 2005, are governed by the latest “vehicle” to roll out of the time-share assembly line – the new California Vacation Ownership and Time-Share Act of 2004, a comprehensive law which became effective on July 1, 2005 (“the Act” or “the new Act”). Its importance is shown by the Legislature’s specific recognition that the tourism industry is a vital part of the State’s economy, and that the sale, promotion, and use of time-share plans is an emerging distinct segment of the tourism industry.
