Title Insurance

We are frequently retained by title companies to represent policyholders in all facets of real property litigation, and we have extensive experience defending title insurers in complex claims involving breach of contract, bad faith and unfair business practices.

In addition to litigation, our Title Industry Practice Group regularly advises insurers on compliance-related matters, as well as issues involving licensing, product design and development, business programs and ventures, underwriting and the handling of claims. We often provide coverage analysis in coverage disputes between the title insurers and policyholders.  We represent the American Land Title Association (ALTA), the national trade association for the title industry and we have also represented the California Land Title Association (CLTA), the state trade association, in addition to other notable industry groups.

We are nationally recognized for our expertise in compliance initiatives vital to the heavily regulated insurance industry. Our clients include individual title companies, but we also represent the interests of the entire title industry on behalf of ALTA. This representation extends to appearances and advocacy before numerous state Departments of Insurance and the National Association of Insurance Commissioners. In addition, our regulatory practice includes advising insurers on product design, development and licensing.

Our team of litigators has developed a highly specialized expertise defending the interests of policy holders, as well as representing insurers in the litigation of bad faith claims. This team is noted for its extensive trial experience and the “depth of its bench.” As many disputes extend beyond title and escrow issues, we also have a seasoned roster of attorneys who add their expertise to other real estate and business matters.

In addition to sharing knowledge and experience with clients, Miller Starr Regalia attorneys author the 12-volume Miller & Starr, California Real Estate 3d, the most widely used and judicially cited real estate treatise in California. The “Escrow” and “Title Insurance” chapters are written and edited by Rich Carlston, who is Chair of our Title Industry Practice Group and a national leader in the title insurance industry.
