Biography

General: Mark has protected and recovered assets and advised regarding the legal rights of high net-worth owners of businesses and real estate assets, quality fast food chains, commercial building owners and lessees, banks, developers, manufacturers, contractors, realtors, wineries, insureds, and court-appointed receivers.

Environmental: Mark has advised, negotiated, and litigated in matters concerning regulatory compliance, all appropriate inquiries, bona fide prospective purchaser protections, cost-effective remediation, private damages claims, and environmental insurance, working with county environmental agencies, Regional Water Quality Control Boards, the Department of Toxic Substances Control, and the EPA. Clients have successfully resolved legal problems arising from contamination of soil, soil vapor, groundwater, and indoor air by PCE, TCE, PCBs, BTEX, MTBE, other petroleum products, and lead. Transactional advice and drafting has helped clients predict and control environmental liability risks and costs and qualify for legal safe harbors associated with the ownership, sale, purchase, and leasing of contaminated real estate. Some have recouped large sums from insurers or contaminators.

Lending: Mark has enforced secured commercial loans and unsecured guaranties in excess to $60,000,000, including participated loans, and effected receivership, foreclosure, attachment, deficiency recovery, and preservation of rents, entitlements, and tenants key to real property value. Mark has defended against lender liability claims.

Construction: Mark has written extensively for the profession concerning California construction defects law. He has handled disputes over construction product defects, delays, contracts, and subcontractor and insurer obligations, often in the context of large residential subdivisions.

Hiking, golf, travel, rafting, disc golf, mountain biking, and current events. Past collegiate team experience in tennis and volleyball.
