Program Description

Recent eminent domain case law has seen some dramatic, and sometimes inconsistent, developments. Property Reserve v. Superior Court, currently under review by the California Supreme Court, has caused a re-examination of what constitutes a "taking" within the meaning of the California Constitution and could have very broad implications. The question of which issues are to be decided by the judge and which go to the jury has also become particularly nettlesome, with different courts seemingly coming down on different sides of this issue. Join us as we explore these recent trends in eminent domain law.
